The citizens' constitutionally protected right (1) to be free of governmental intrusion and (2) the law enforcement officers' authority to stop and arrest a criminal offender creates an inherent conflict. The inherently conflicting nature within the context of law enforcement demands that the leader of a law enforcement organization rigorously understands the constitutional needs and protections of the people he or she is serving. A reasonable person would have to ask, since the incumbant Sheriff does not follow the law, does the Sheriff understand how the constitutional protections guaranteed to all people in the United States and its territories are intended to protect the people? Does he have the experience and understanding in order to know how the conflict inherent in the "enforcement side" of the law affects our people in Lee County? The answer is: No!
