Appeal to protect the Constitution: What you, anywhere in the U.S., can do to protect the Constitution

Dear United States Resident:

Our courts of law are supposed to provide our people—litigants—with a process that is fair, reasonable, and comprehensible. Judges are supposed to act in the capacity of a referee, i.e., they cannot, under any circumstance, become a player in the litigation, acting as if they are an adversarial party litigant. Much too often, judges involve themselves in the litigation by refusing to apply the procedural rules to all parties, equally. These are the rules that are intended to protect the litigants, intended to protect them from undue prejudice and irreparable harm. These judges have been caught sending emails (impermissible ex parte communications) to the banks’ attorneys, without letting the homeowners or their attorneys know about their communication. These are the types of abuses from which our Founding Fathers wanted us protected. These abuses, in America, constitute an abuse of process of enormous proportions.

Federal Government’s Involvement

At the national level, our federal government has given favors to financial institutions, allowing banks to manipulate and ruin the American economy. Banks have lied to Wall Street investors and have gone as far as deceiving the international community. Banks have accomplished their deeds, in part, by encouraging rating agencies to create the appearance that borrowers were financially sound when they were not. They also accomplished their deeds by telling borrowers that they do not need to worry about whether their income could support their mortgages. They were told to put onto paper (mortgage application) a figure that was more than what they earned. These favors have handicapped our nation, and they are in the process of destroying American capitalism (your privilege to enjoy business activities and properties). Today, the damages are heartfelt and real. Americans are unemployed, their properties (real estate) have substantially devalued, and the Dollar has lost its purchasing power. The most recent recession (2007 through 2013 and beyond) is man-created. Do not let government fool you to believe that, somehow, loss of employment and loss of property are the cause of natural forces. Government has artificially stimulated the economy by allowing banks to hand out, at literally no cost to them, mortgages to people who could barely afford to pay their rent let alone commit to a higher mortgage payment. As a result of this deception, a minuscule number of people have reaped enormous financial benefits. It is no longer the rich versus the poor, but it is all of us versus a very few individuals who have accumulated enormous wealth at our expense.

Economic Meltdown [Click Here]

Federal legislation has gone as far as taking tax payers’ moneys out of their (your) wallet in order to re-fund, in the form of a massive bailout, the collapsing firms (e.g., AIG) that have insured securities instruments, which ratings firms have fraudulently rated. The perverted rating agencies have lied to local and international investors, attempting to turn sub-par borrowers into stellar performers in return for huge profits. The rating firms’ lies surfaced during the economic collapse. The federal bureaucrats reasoned (and continue to reason) that these institutions need to be bailed out with your money in order to prevent the meltdown of our economy, in the interest of national stability. This, however, is as much an aberration of our republic as it is a smack in the face, insulting the mom and pop stores which do not get bailed out for any of their failures (if any). When these federal bureaucrats fail to get re-elected, they get cushy CEO jobs at the institutions they have (so-called) rescued, earning 100s of thousands of Dollars in compensation and benefits.

The Sheriff [Click Here]

The purpose of this letter is to inform you about the powers and the duties of a local sheriff. I also want to inform you about what he or she can do, as part of his sworn duty to protect the Constitution. To forewarn, the authority of a protector sheriff is not as limited as you might have been influenced to believe. The sheriff is not merely a traffic cop; he is so much more than that. The sheriff is, above all others, the senior law enforcement executive of the County, and he answers only to the people of the County. The sheriff has the legal obligation to protect the people from peril and to protect from many types of interference. The question is: What can the local sheriff do? This question was presented by Sheriff Richard Mack in Graham County, Arizona, and, the United States Supreme Court, in 1997, gave the answer in Mack versus United States. The Mack court decision stated in essence that the sheriff is the protector of the Constitution, the protector of the people, the protector of the people’s rights, federal and local. The Mack decision held that the sheriff is a Constitutional officer and not a puppet for the federal agenda. The Mack decision makes it evident that the Constitutionally required checks and balances are intact (separation of State and Federal government, Tenth Amendment) and that the sheriff is the gate keeper, charged with the duty to protect the checks and balances. The beauty of the Mack decision is that the United States Supreme Court has specifically addressed the powers of the sheriff.

I met with former Sheriff Richard Mack of Graham County, Arizona, and it became quite clear that, to protect the Constitution, the sheriff has the authority to engage in any means which are authorized by the Constitution. The checks and balances, both federal and state, both local and national, are in dire need to be preserved. If it is necessary, the local sheriff, in light of Mack v. United States, has the authority to shut down a noncompliant federal facility because the sheriff is the local gatekeeper. The local sheriff is charged with the duty to protect what our founding fathers intended for us to have (the rights in the Constitution of the United States of America).

The Systematic Taking of Property [Click Here]

You see, when national government usurps its powers and steps into our lives, destroys our property values and allows the banks to systematically seize our land and deliver it into the hands of the banks’ and government's possession, then government is out of control. You see, when local government usurps its powers, acting as if it has the authority to perform favors to banks by engaging in forbidden ex parte communications (with one party of the litigation), government is out of control. When judges are no longer capable of adjudicating impartially, when they are no longer willing to act as referees as required by law (in contrast to being a player), when they refuse to issue orders (re discovery) that protect litigants from the opposing litigants’ lies, government is out of control, and our nation is at peril.

The evidence of abuse is overwhelming. I have reported an overwhelmingly large number of them in the 1-26-2011 Wewepeaks Comprehensive Report, a.k.a., Manifesto on Procedural Rights. In light of this agony (the local and federal abuses), I ask that you, upon reading this letter, addressed to the attention of every person in the United States, reach out and make your voice heard.

On the day the sheriff takes the "Oath of Office," he or she swears: "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God” (Oath enacted by Congress in 1862).
